Terms of service.
The agreement between you and Kanvas when you take a Kanvas One plan.
1. Who you are contracting with
“Kanvas One” is the service provided by Kane Foster, a sole trader trading as Kanvas One. In these terms “we”, “us” and “Kanvas” mean that business, and “you” means the business taking the plan.
You can reach us at hello@kanvas.one. Our full contact details are on the contact page.
These terms are written for businesses. If you are taking a plan as a consumer rather than for the purposes of a business, see section 8.6, which sets out the cancellation rights you have on top of everything else here.
2. What we provide
On an active plan we design, build, host and look after a website for your business. Depending on your plan that can also include a mobile app, ongoing search work, advertising run for you on Meta’s platforms, automated customer emails sent on your behalf, business email at your own address provided through Google Workspace, and a web address registered and renewed for you. Email runs on Google’s service under Google’s own terms, and like everything else here it is included while your plan is active.
What each plan includes is set out on the plans page and the what’s included page. Those pages form part of these terms. Where a description there conflicts with a clause here, the clause here applies.
We provide the service with reasonable skill and care. We do not promise any particular commercial result — a number of enquiries, trial bookings or new members, a search ranking, sales, or app downloads. Search engines and app stores are run by third parties and neither we nor you control them.
3. Edits, features and priority
After your site is live you can keep asking for changes. There is no monthly allowance and no per-change fee: edits and new features are included on every plan.
- An edit is a change to existing pages: wording, images, design, prices, structure.
- A feature is something new that did not exist before: a booking form, a gallery, an extra page with new functionality.
- The distinction only affects how long the work takes, never what it costs.
Edits on Starter. On Starter you can ask for edits to what is already on your site — wording, images, prices, opening hours, contact details and links — whenever you need them. There is no limit on how many you send or how often, and no charge for any of them. We work through them in the order they arrive, as quickly as we reasonably can. Starter has no set turnaround time, and Business and One requests are handled first (see Priority below). Something new that the site does not already do, such as online bookings, payments, live chat or an extra form, is a feature, and features are part of Business.
Priority. Requests are worked through one at a time for each site, One requests first, then Business. Then Starter. Within a plan, the request waiting longest goes next. Edits are included on every plan, and new features on Business and One, at no extra charge; a feature we build for one customer may be offered to others afterwards (section 10 covers who owns what). One buys a place at the front of the queue plus its own extras — monthly search and site improvements, a business email inbox, automated customer emails, and advertising run for you. One is built as a model for a business type (for example Trades, Clubs or Salon); which model applies is agreed when you join, and the same price applies whatever the type.
Advertising on One. On One we set up, run and monitor advertising for your business on Facebook and Instagram. Who pays Meta for the ads is set out under “Ads on One” in section 6: in your 3 months of ads we pay Meta ourselves, up to £100 a month; after that, any ads you keep are paid by you directly to Meta on your own ad account, you can change or pause the budget at any time, and we never hold or spend your advertising money. While you keep a budget running, we keep running the ads as part of One: reviewing them each month, pausing ads that are not working, refreshing the creative and testing new ads. We need admin access to your Facebook page and ad account, and at least a photo or a line of text from you, before anything can run. We write the offer and the ad, build the form or page it leads to, and send you a monthly note saying what ran, what it cost and what came in. Your first ad goes live once your website and member app are both live (section 4) and we have the access and material we need from you; Meta’s own review of a new ad account or a new ad can take longer, and that part is not ours to control. This is work we do with reasonable skill and care, not a promise of any number of leads, sales or a cost per lead (section 2). Meta’s own advertising policies apply and may stop an ad running; where they do, we tell you and rework it. We run advertising for a limited number of businesses at a time so each one gets proper attention; the number and the current price are shown on the plans page. A price shown to you when you joined One stays your price while you remain on it.
Search on One. On One we build and keep your site so search engines and AI search tools can understand it: pages for what you offer and where, structured information about your business, your Google Business Profile kept up to date with your access, and reviews asked for automatically. This is work we do with reasonable skill and care. Google, AI search tools and other third parties decide what they show and in what order, so we do not promise any ranking, position or number of visitors (section 2).
Fair use. Unlimited means you are never charged for asking; it does not mean parallel teams working simultaneously. We do requests in order, at a pace that keeps every customer’s work moving. If a run of requests is large enough that it would crowd out other customers, we may schedule it across a longer period, and we will tell you when to expect what.
Any live tool we set up for you to run yourself — a menu, your prices, a timetable — is always free for you to change instantly, without asking us at all.
We decide in good faith whether a request is an edit or a feature, and how requests are ordered within the rules above. If you disagree, tell us and we will explain the reasoning.
4. Getting your site built
Starter: live within 24 hours. When you join Starter, we build your site from our designs around your business, using the page you sent us when you joined (your Instagram, Facebook or current site), register your web address (or point one you already own) and put it live within 24 hours. Registries and DNS are run by third parties; where one of them delays, we put it live as soon as it clears and tell you.
Business: ready in 7 to 14 days. When you join Business, we build your site and the features you chose when you signed up (up to three), register your web address (or point one you already own), and set up what those features need, such as card payments and email. It is ready within 14 days of joining, often sooner. On Starter the site is built from our designs around your business, with a contact form and click to call, and you can ask for edits from day one. Anything you ask for after that, on either plan, is built in the usual way, in turn, under section 3. If your Business site is not ready within 14 days, your next month is free: we credit one month of your plan to your account, applied by Stripe against your next payment. The credit is not paid in cash and does not apply where a plan is cancelled before the credit is used.
The 14 days pause while we are waiting on something we have asked you for — photos, prices, wording, or your approval of a change — and restart when it arrives. We will always ask before the clock stops, and chase before it matters.
One: your website and app. When you join One we send you a setup form about your business. Your website is ready 7 to 14 days after you complete it, often sooner; anything you leave out, we ask about, and the build waits for the answer where it needs it. We build your member app and submit it to the App Store and Google Play as soon as your own developer accounts are ready (section 6). How long Apple and Google take to review and approve it is up to them, not us: usually 1 to 4 weeks, sometimes longer, and either of them may ask for changes first. Until it is approved, you and your members use the same features on your website. Your ads start once your website and app are both live, usually 4 to 8 weeks after you complete your setup form. If Apple or Google have still not approved your app 8 weeks after you complete your setup form, we start your ads anyway, with you and your members using the app on your website until it is approved. Apple asks a business for a D-U-N-S number (a free company identifier) before it opens a developer account, which can take a week or two, so we ask you to start your accounts when you join. The 24 hours, the 14 days and the free month above are for Starter and Business; they do not apply to One.
If we cannot start because we are waiting on something from you, the plan still runs and is still billed.
5. Your content, and what we need from you
You give us text, images, logos, menus, prices and similar material so we can build the site. By giving it to us you confirm that you own it or have permission to use it, and you allow us to use, copy and publish it for the purpose of building and running your site and app.
You are responsible for the accuracy of what you give us, including prices, opening hours, allergen and ingredient information, and any claims about your business. We publish what you send; we do not verify it.
You agree to indemnify us against claims brought by someone else because material you supplied infringed their rights or broke the law.
6. Price, payment and VAT
Plans are billed monthly in advance by card through Stripe. The first payment is taken when you sign up and starts the build. There is no setup fee.
Prices are shown in pounds sterling. We are not currently VAT registered, so the price you see is the total price and no VAT is added to it. If we become VAT registered we will tell you before it affects your bill.
Your payment date each month is the anniversary of your first payment. We never see or hold your card number; Stripe does. Their terms and privacy notice cover that part.
Monthly plans. Starter is charged at its standard price, £9.99 a month, from the first payment. On Business, a new customer’s first month is half price. It is applied by Stripe at checkout, once, on the first payment; the plan continues at its standard price from the second month unless you cancel. A partner or referral code you bring replaces it rather than stacking with it.
Annual plans. An annual plan is paid once, up front, for twelve months of service: £99 for Starter, and ten months’ price for Business. One is monthly only. An annual plan also includes the Launch Boost: in the first month after your site goes live we set up and verify your Google Business Profile, add a page for each service you offer and each area you cover, mark up your business details for search engines and AI assistants, submit the site to Google, ask your first customers for reviews, and send you a note at the end of the month showing where you appear. This is work we do, not a promise of any position or result (section 2). The half-price first month does not apply to annual plans.
10 trials or enquiries in 3 months, or 3 months free. If the ads we fund in your 3 months of ads (below) bring fewer than 10 trials or enquiries in total, your next 3 months of One are free: we do not charge the £250 fee for the 3 monthly payments that follow. If your business runs classes or sessions that people try first, such as a club, school, gym or studio, we count trial bookings: a booking for a free or paid trial made through the system we run for you. For any other business, such as a trade, a salon or another service, we count enquiries: a potential customer getting in touch through the system we run for you, by a form on your website or ad, a call to your business number or a live chat message, counted once per person. A trial booking counts whether or not they turn up, and an enquiry counts whether or not it becomes a booking or a sale. This applies when the ads ran for all three months, were not paused or switched off at your request, were not paused because your classes or diary were full, and you gave us what we asked for to run them (such as access to your Facebook page and photos or video). It is applied automatically and needs no claim.
Ads on One. On One, we first build and test your website, member app and bookings, and your ads start once your website and app are both live (section 4). For the 3 months from the day your first ad goes live (your “3 months of ads”) we pay for your Facebook and Instagram ads, up to £100 a month, while you stay on One; any of that amount not spent in a month does not carry over and has no cash value. After your 3 months of ads, advertising is optional. If you want to keep it running, you set a budget and pay Meta for it directly on your own ad account; you can change or pause it at any time, and we keep running the ads as part of your One plan at no extra charge. If you would rather stop, we switch the ads off and everything else in One carries on at the same price. We never take a share of what your customers pay you. We pause the ads for classes that are full. What the ads bring is not guaranteed: it depends on your type of business and your local area, and any figures we show from our own academy are examples, not a forecast (section 2). One has no minimum term: you can cancel any time under section 8, and the ads we pay for stop when your plan ends.
Your app in the App Store and Google Play. On One your member app, used by you, your coaches and your members, carries your own name and logo, so it is published under your own developer accounts: an Apple Developer Program membership and a Google Play Console account, both in your business’s name. You pay Apple and Google for these directly, not us. At the time of writing Apple charges about £79 a year and Google a one-off US$25; these fees are set by Apple and Google, can change, are not part of your plan fee and are not refundable by us. You stay the owner of both accounts and give us access so we can publish and update your app. Store versions follow once Apple and Google approve them; how long that takes is up to them, not us, usually 1 to 4 weeks and sometimes longer (section 4). Until then your app works from your website. If an account is not set up or a membership lapses, the store versions cannot be published or kept live, but your app still works from your website while you are on One.
Texts and calls on One. Each monthly payment period includes £5 of texts (SMS) and phone calls through your business number, at what the phone network provider charges us: at the time of writing about 100 texts of up to 160 characters, or about 100 minutes of calls made from your app, or a mix. This covers texts the system sends for you, such as trial reminders and missed-call texts, as well as texts and calls you or your team make. A longer text, or one with emoji, counts as two or more texts, as the mobile networks charge for it. Unused allowance does not carry over. Use beyond £5 is charged at about 5p a text and 5p a minute, added to your next monthly payment; automatic texts keep sending, and your app tells you before you send a text or make a call over the allowance yourself. Live chat, push notifications, in-app messages and email are not part of the allowance and are always included.
Card payments on One. Your members pay into your own Stripe account. We take no share or fee from what your members pay. Stripe charges its own fees to your account under your agreement with Stripe.
Other promotional codes we offer from time to time work as described wherever you were given them, are applied by Stripe at checkout, and cannot be exchanged for cash or applied to payments already made.
If a payment fails, we tell you and retry it automatically for 14 days. Your service carries on as normal during those 14 days, and updating your card from your account settles it straight away. If payment still has not gone through after 14 days, your plan ends, and your site, app and anything else we run for you stop.
We may change plan prices. We will give you at least 30 days’ notice by email before a change affects you, and you can cancel under section 8 if you do not want to continue at the new price.
7. Changing plan
You can change plan at any time from your account.
Moving up
An upgrade takes effect immediately. Stripe prorates it: you pay the difference between the two plans for the rest of your current month, not a fresh full month. Your requests move up the queue straight away.
Moving down
A downgrade takes effect at your next payment date. You keep the plan you have paid for until then, and there is no refund for the unused part of the month. Your queue position moves when the new plan starts.
8. Cancelling
You can cancel at any time. No further payments are taken after you cancel, and the service runs to the end of the period you have already paid for — the month, or on an annual plan the year. Nothing is locked in, and there is no exit fee.
8.1 To cancel, use the billing portal from your account, or email us. Cancelling in Stripe and telling us are equivalent; you do not need to do both.
8.2 When the period you have paid for ends — the month, or on an annual plan the year — we take the site offline and stop the plan.
8.3 What you take with you. On request we send you an export of your content and data — the text, images and business information you gave us, and anything your site collected for you, such as enquiries and customer details — and we transfer your web address to you with its transfer code, free of charge (section 9). The site itself — the design, pages, features and code — is part of the service rather than something you buy, so it stops with the plan and is not handed over. Section 11 says more about who owns what.
8.4 Six months to change your mind. We keep your site build and account data for six months after your plan ends. Restart within that time and everything picks up where it left off — the same site, the same features, usually back online within days. If the account stays unused for six months, the build and the data are permanently deleted, and coming back later means starting a fresh build.
8.5 Payments already taken are not refunded, including where you cancel part way through a billing period. The credit under section 4 is a credit against a future payment, not a refund. This applies to annual plans in the same way: cancelling part way through a year does not refund the remaining months — your site simply stays online and looked after until the year you paid for ends.
8.6 If you are a consumer
If you are taking a plan as an individual rather than for business purposes, the Consumer Contracts Regulations 2013 give you 14 days from signing up to cancel for any reason. Because we start the build as soon as you sign up, you are asking us to begin during that period; if you then cancel within the 14 days, we may charge you a proportionate amount for the work already done. This right is in addition to, not instead of, your right to cancel at any time above.
9. Your web address
Where your plan includes a web address, we register and renew it for you and pay the registry fees for as long as your plan is active.
The web address is yours. If you leave, we will transfer it to you or to a registrar of your choosing, free of charge, provided your account is settled. Ask us and we will start the transfer; registry rules mean it can take a few days, and some registries impose their own waiting periods that we cannot shorten.
If you already own a web address, you keep it and we point it at the site we build. It never passes to us.
10. Who owns what
You own your content: your text, images, logo, brand and business information, before and after we use them.
The site itself — its design, layout, pages and features — is part of the service. We build it and keep it running for as long as your plan is active; it is not a deliverable you buy, and it does not transfer when you leave. What you do take with you is set out in section 8.3: your content, your data and your web address.
We keep ownership of the underlying platform, templates, components, tooling and code that we reuse across customers. You are not buying that; you are licensed to use it for as long as your plan is active. That is what makes a monthly price possible instead of an upfront build cost.
We may show your site in our portfolio and marketing, and name you as a customer. Tell us if you would rather we did not, and we will not.
11. Acceptable use
You must not use the service, or ask us to build anything, for:
- anything unlawful, or that infringes someone else’s rights;
- content that is misleading about your business, its prices, or its credentials;
- adult content, gambling, weapons, illegal drugs, or anything our hosting or payment providers prohibit;
- malware, phishing, scraping other sites, or sending unsolicited bulk email;
- collecting personal data from your own customers without a lawful basis and a privacy notice of your own.
You must keep your account login to yourself and tell us promptly if you think someone else has it.
12. Availability
We aim to keep your site available at all times, and it runs on infrastructure built for that. We do not offer a contractual uptime guarantee or service credits on these plans.
We may take the site down briefly for maintenance, and will avoid busy periods where we can. We are not responsible for outages caused by your domain registry, a payment provider, an app store, or a general internet failure.
If something breaks on a site we built, fixing it is included in your plan, always, at no charge.
13. When we can suspend or end a plan
We may suspend the service if payment fails and stays unpaid after the 14 days described in section 6, or if content breaches section 11, or if we are required to by law or by a provider we depend on. Where the law allows, we will warn you first and give you a chance to fix it.
We may end a plan by giving you 30 days’ notice, and will refund any period you have paid for beyond that date. We will transfer your web address to you as set out in section 9.
14. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be limited.
Subject to that, and because this is a business-to-business contract:
- we are not liable for loss of profit, loss of business, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss;
- our total liability to you in any twelve-month period is limited to the total amount you paid us in that period.
Keep your own copies of anything you would not want to lose, such as original photographs and written copy. We do not promise to hold backups of the material you send us.
15. Data protection
How we handle personal data about you and the people who contact you is set out in our privacy notice.
Where your site collects personal data about your own customers — a contact form, a booking, a mailing list — you are the controller of that data and we are your processor. You are responsible for having your own privacy notice and a lawful basis for collecting it. We will only process it to run your site, keep it secure, and follow your instructions. Ask us if you need a written data processing agreement and we will provide one.
16. Changes to these terms
We may update these terms. If a change materially affects you we will email you at least 30 days before it takes effect, and you may cancel under section 8 if you do not accept it. The date at the top of this page shows when it last changed.
17. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
If something has gone wrong, email hello@kanvas.one first. We would much rather fix it than argue about it.
